本服务条款自寄件人签署之日订立，订约双方为中海外及寄件人，订约双方均须遵守本服务条款。本条款所称“货件”，是指已抵达我公司或由我公司工作人员签收的货物，每一货件运输都将适用本条款中关于责任限制的规定。如寄件人要求更大程度的保护，可另行购买保险。

This service terms are concluded on the date of signing by the sender, and the contracting parties are China Overseas and the sender. Both parties must comply with these service terms. The term "shipment" refers to goods that have arrived at our company or have been signed for by our staff. Each shipment will be subject to the liability limitation provisions in this article. If the sender requires greater protection, they can purchase additional insurance.

一、限寄和禁寄的货件

I. Restricted and prohibited shipments

寄件人同意其交寄的货件都是可运输的。

The sender agrees that the goods they send are all transportable.

以下货件不予收寄：

The following shipments are not accepted for posting:

1）属于国际航空货运协会（IATA）、国际民用航空组织（ICAO）及其他相关政府部门或组织所规定的有害物品、危险物品，以及属于禁运或限运的物品（限制投寄的物品：电池、含电池的物品、紧急用于医疗或科研的药品、体育用的、活动物、未超标准的磁性物品、易腐品、放射性物品、疫苗、私章或公章等）。

1) Hazardous and dangerous goods as stipulated by the International Air Transport Association (IATA), the International Civil Aviation Organization (ICAO), and other relevant government departments or organizations, as well as goods that are embargoed or restricted (restricted items: batteries, items containing batteries, drugs for emergency medical or scientific research, sports, live animals, magnetic items that do not exceed standards, perishable goods, radioactive items, vaccines, private or official seals, etc.).

2）中海外认为不能安全、合法运输的物品（包括但不限于：假冒伪劣物品、 喷雾容器、酒精类液体、石棉、丁烷打火机、医疗废品、毒性物品、腐蚀物品、食品、茶叶、现金、支票、假钞、药品、干冰、易燃易爆品、淫秽物品、超过标准的磁性物品、氧化物和有机过氧化物、武器、溶解性油漆涂料、动物、现钞、不记名可议付票据、贵重金属和矿石、火器、、人体、色情物品和非法的麻醉药品/毒品和其他当地法律禁止邮寄的物品）。

2) Items that China Overseas Holdings Limited believes cannot be transported safely and legally (including but not limited to: counterfeit and shoddy goods, spray containers, alcohol-based liquids, asbestos, butane lighters, medical waste, toxic substances, corrosive substances, food, tea, cash, checks, counterfeit currency, drugs, dry ice, flammable and explosive materials, obscene materials, magnetic items exceeding standards, oxides and organic peroxides, weapons, soluble paint coatings, animals, cash, bearer negotiable instruments, precious metals and ores, firearms, human bodies, pornographic materials and illegal narcotics/drugs, and other items prohibited by local laws from being mailed).

二、查验

2、 Inspection

中海外有权在未事先通知寄件人的情况下对货件进行抽样开封查验，如查出限寄或禁寄物品，中海外将扣留当天所有货件，不做发货处理。货件扣留一周后返还给寄件人，并且寄件人须向中海外支付500元/次的违禁品查验费。

COSCO has the right to open and inspect the shipment without prior notice to the sender. If any restricted or prohibited items are found,China Overseas  will detain all shipments on the same day and will not process the shipment. The shipment will be returned to the sender after one week of detention, and the sender must pay a 500 yuan/time inspection fee for prohibited items to China Overseas

三、派送和不能派送

III. Delivery and Non-delivery

寄件人确保提供收件人的准确性和完整性，货件不能按照某邮政信箱（PO BOX）或仅能按邮政编码派送，将按寄件人提供的收件人地址派送（在邮政投递中邮件的第一接收者应被视为收货人），但不一定直接送达收件人本人。如果收件人地址设有集中接收点，货件将被派送到该接收点。

The sender ensures the accuracy and completeness of the recipient's address. If the shipment cannot be delivered to a specific PO Box or only by postal code, it will be delivered to the recipient's address provided by the sender (the first recipient of the mail during postal delivery should be considered the consignee), but it may not necessarily be delivered directly to the recipient. If there is a centralized receiving point for the recipient's address, the shipment will be delivered to that receiving point.

有以下情形之一的，中海外将以合理的方式依寄件人要求处理货件，因此发生的额外费用由寄件人承担：

In any of the following circumstances, China Overseas will handle the shipment in a reasonable manner according to the request of the sender, and the additional costs incurred shall be borne by the sender:

1）收件人拒绝接收货件或支付税费；

1) The recipient refuses to receive the shipment or pay the taxes and fees;

2）该货件被认为是不可接受的；

2) The shipment is deemed unacceptable;

3）海关认为寄件人清关资料与实际货物不符（货物发出的清关发票寄件人为中海外，如海关要求提供真实寄件人盖章的清关资料，寄件人需自行配合海关处理）；

3) The customs deems that the sender's customs clearance information does not match the actual goods (the customs clearance invoice sent by the sender of the goods is for China Overseas, if the customs requires the sender to provide the customs clearance information with the real sender's seal, the sender needs to cooperate with the customs on their own);

4）无法确定或找到收件人。

4) The recipient cannot be determined or found.

如寄件人不能及时提供处理意见或目的国政府不能接受寄件人的处理意见，中海外可有权放弃该货件，且无需向寄件人或其他人承担任何责任。

If the sender cannot provide timely handling suggestions or the destination country government cannot accept the sender's handling suggestions, China Overseas may have the right to abandon the shipment without any liability to the sender or others.

四、运费

4、 Freight

中海外网站公布的运费不包括偏远费和特殊产品、特殊包装的相关附加费用，部分货运方式需以货物实际重量或体积计算标准两者中较高的计算，中海外可以对任何货物重新称重和测量以确认其计算数据。寄件人应向中海外支付或返还运输服务中由中海外自身收取或代表寄件人、收件人及任何第三方所发生的所有运费、附加费、仓储费、关税等税费（部分快递方式可能无法预先得知附加费用，最终费用以承运商账单为准）；当所寄运的货件属于本条款第3条所称的不可派送的情形时还应向中海外支付所有由此引发的退回运费、进口费用、赔偿、损害、罚款等相关的费用。

The shipping fees published on the website of China Overseas do not include remote fees and additional fees related to special products and special packaging. Some shipping methods require the calculation of the higher of the actual weight or volume of the goods. China Overseas can re-weigh and measure any goods to confirm their calculation data. The sender should pay or return to China Overseas all shipping fees, surcharges, storage fees, tariffs, and other taxes incurred by China Overseas itself or on behalf of the sender, recipient, and any third party during the transportation service (some express delivery methods may not be able to predict the additional fees in advance, and the final cost is subject to the carrier's bill); when the shipment belongs to the situation of non-delivery as mentioned in Article 3 of this clause, all related expenses such as return shipping fees, import fees, compensation, damages, fines, etc. should also be paid to China Overseas.

五、货物退回

V. Return of goods

1）寄件人委托中海外所承运的货件出现本协议第三条“派送和不能派送”所述原因之一的，经双方确定后由中海外退回国内操作中心。

1) If the shipment entrusted by the sender to be carried by China Overseas has one of the reasons described in Article 3 of this agreement, "delivery and non-delivery", it shall be returned to the domestic operation center by China Overseas after confirmation by both parties.

2）中海外对寄件人所需退回的货件不做时间承诺，以中海外具体通知时间为准。

2) China Overseas does not make a time commitment for the return of goods required by the sender, and the specific notification time from China Overseas shall prevail.

3）中海外对寄件人因任何原因滞留的货件，可提供7天免费保管服务，7天内中海外会以电话、邮件的方式联系寄件人征求处理意见；超过7天中海外将按深圳仓储业务的方式向寄件人收取相关费用；超过6个月以上，寄件人仍未给予处理意见，中海外视情况予以销毁处理。

3) For shipments that are delayed for any reason by the sender, China Overseas can provide a 7-day free storage service. Within 7 days, China Overseas will contact the sender by phone or email to seek advice on handling; if more than 7 days, China Overseas will charge the sender for related expenses according to the Shenzhen warehousing business method; if more than 6 months, and the sender still does not provide any handling advice, China Overseas will destroy the shipment as appropriate.

六、中海外的责任

VI. Responsibilities of China Overseas

中海外基于本条款对寄件人所承担的责任仅限于直接损失，且不超过各运输方式公布的限额。因寄件人可事先对特殊风险投保，中海外不承担任何其它损失或损害（包括但不限于利润、收入、利息及未来业务的损失），无论这些其它损失或损害是特殊的或是间接的，无论中海外是否在受理货件之前或之后知晓存在这些损失或损害的风险。每票货件只能提出一次索赔，且这种赔偿将作为对有关损失及损害的全部和最终的解决方案。如寄件人认为本条款关于赔偿的规定将不足以补偿其损失，则应对货物价值进行自行投保，否则寄件人将承担一切损失和损害的风险。

The liability of China Overseas to the shipper based on this clause is limited to direct losses and does not exceed the limit published by each mode of transportation. Since the shipper can insure against special risks in advance, China Overseas will not bear any other losses or damages (including but not limited to profits, income, interest, and losses of future business), regardless of whether these other losses or damages are special or indirect, and whether China Overseas is aware of the risk of these losses or damages before or after accepting the shipment. Each shipment can only file one claim, and this compensation will be used as the full and final solution for the relevant losses and damages. If the shipper believes that the compensation provisions in this clause will not be sufficient to compensate for its losses, it should insure the value of the goods on its own, otherwise the shipper will bear all the risks of losses and damages.

七、货物查询

VII. Cargo Inquiry

对承运商可提供查询的货运方式（平邮小包以外的其他货运方式）出现以下情况之一的，寄件人可向中海外提出查询申请：

In case of any of the following circumstances with respect to the freight methods (other than surface mail parcels) that can be inquired by the carrier, the sender may submit an inquiry request to China Overseas:

1）货物未按正常处理时效显示网上跟踪信息；

1) The online tracking information for the goods is not displayed according to the normal processing time limit;

2）货物在超出所选择运输方式承诺时效未派送成功；

2) The goods have not been successfully delivered within the promised time limit for the selected transportation method;

3）货物在所选择货运方式对应查询网站上显示派送成功，收件人反应未收到包裹（中欧专线EUEXP除外）；

3) The goods are displayed as successfully delivered on the corresponding query website for the selected shipping method, but the recipient reports that they have not received the package (except for the China-Europe dedicated line EUEXP);

4）收件人反应货物损坏，减少，与发出货物不一致；

4) The recipient reports that the goods are damaged, reduced, or inconsistent with the goods sent;

5）产生不明费用。

5) Unexplained expenses.

寄件人在发货时应确保货物信息详细准确，在查询时需提供查询货物的相关信息，如因货物发出时的信息与提交查询时信息不符，或寄件人提交的货物信息不符合查询条件造成的承运商拒绝查询，一切损失和责任由寄件人承担。由于国际运输货件查询存在的时间、空间和中转环节限制，不同国家和不同运输方式的查询期存在差异，中海外将以合理的努力为寄件人查询货件，但不对承运商的延迟回复承担责任。

The sender should ensure that the goods information is detailed and accurate when shipping, and provide relevant information for querying the goods during the query process. If the information provided at the time of shipment does not match the information submitted for query, or if the goods information submitted by the sender does not meet the query conditions, resulting in the carrier's refusal to query, all losses and responsibilities shall be borne by the sender. Due to the time, space, and transit restrictions of international shipping, there are differences in the query period between different countries and different modes of transportation.China Overseas will make reasonable efforts to query the shipment for the sender, but will not be responsible for any delayed response from the carrier.

八、索赔

8、 Claims

任何索赔必须在中海外各货运方式查询期结束后提出。

Any claim must be made after the end of the inquiry period for each mode of freight transportation of China Overseas.

1）中海外内部丢失

1) Lost within the China Overseas Land & Investment

从中海外签收货件到中海外将货件交寄到承运商之间，如果发生货件丢失，中海外将承担赔偿责任。责任金额根据寄件人在中海外系统中输入的申报价值或产品实际价值(即客户提供的购买凭证和发票等)，二者以较低者为准。单个邮包最大赔偿金额不超过100美元。

If the goods are lost between the time of receipt by China Overseas and the time of delivery to the carrier, China Overseas will be liable for compensation. The amount of liability is based on the declared value entered by the sender in the China Overseas system or the actual value of the product (i.e., purchase vouchers and invoices provided by the customer), whichever is lower. The maximum compensation for a single package is not to exceed $100.

2）承运商丢失

2) Loss of carrier

货件从中海外发出后，承运商会提供相关的交接凭证。如果货件丢失，赔偿责任在于承运商。中海外将协助客户向承运商索赔，索赔额度根据各货运方式的赔偿规定执行。

After the shipment is dispatched from China Overseas, the carrier will provide relevant handover documents. If the shipment is lost, the carrier will be liable for compensation. China Overseas will assist customers in claiming compensation from the carrier, and the amount of compensation will be determined according to the compensation regulations for each shipping method.

3）中海外操作原因导致货件发错地址

3) The wrong address of the shipment was caused by the operation of the overseas company

因中海外操作原因导致货件发错地址，中海外会将已收取的邮寄或快递费用退还给客户，并可选择赔偿物品价值与申报价值较低者，承担邮包从国外退回深圳的平邮邮费，以寄错地址向正确地址转发邮包的平邮邮费中成本最低的方式进行处理。但不承担发错货件的间接经济损失。

If the goods are sent to the wrong address due to the operation of China Overseas, China Overseas will refund the mailing or courier fees already collected to the customer, and may choose to compensate for the lower of the item value and declared value, and bear the postage for returning the parcel from abroad to Shenzhen by surface mail. The lowest cost method of handling the situation is to forward the parcel to the correct address at the cost of the postage for sending the wrong address. However, China Overseas will not bear the indirect economic losses caused by sending the wrong goods.

4）由于海关抽查造成的邮包丢失

4) Lost parcels due to customs random checks

货件在经过海关时，海关打开货件检查，可能导致邮包丢失、邮包内物品（全部或部分）丢失、或被海关扣押。中海外不承担由此带来的任何责任。

When the shipment passes through customs, the customs may open the shipment for inspection, which may result in the loss of the parcel, the loss of all or part of the items inside the parcel, or the seizure of the parcel by customs. China Overseas does not bear any responsibility for this.

九、运输延误

IX. Transport Delay

中海外网站公布的投递时间是从在对应查询网站有操作记录开始至货物到达的时间，但不包括中海外取件的时间、在分拣中心分拣的时间和海关清关时间。这些标准并不属于承诺，也不构成协议的组成部分。中海外不对运输延误而导致的任何损失或损害承担责任。

The delivery time published on the website of China Overseas Land and Investment is from the time of operation record on the corresponding query website to the time of arrival of the goods, but does not include the time of pickup by China Overseas Land and Investment, the time of sorting at the sorting center, and the time of customs clearance. These standards are not commitments and do not form part of the agreement. China Overseas Land and Investment is not responsible for any losses or damages caused by transportation delays.

十、不可抗拒因素

X. Irresistible factors

对于超出承运商控制范围的原因而导致的损失或损害，中海外不承担责任。这些原因包括但不限于：自然灾害，如地震、龙卷风、风暴、洪水、大雾等；战争、空难或禁运等不可抗力；货件固有的缺陷或特性(无论中海外是否知晓)；暴乱或民间骚乱；非中海外雇员或与中海外没有合同关系的人员的作为或不作为，如寄件人、收货人、第三人、海关或其他政府部门；劳资事件；对于电子音像图片、数据或纪录的电磁性损坏或删除。

China Overseas shall not be liable for any loss or damage caused by reasons beyond the control of the carrier, including but not limited to: natural disasters such as earthquakes, tornadoes, storms, floods, heavy fog, etc.; force majeure such as war, air crash or embargo; inherent defects or characteristics of the shipment (whether China Overseas is aware of them or not); riots or civil unrest; acts or omissions of non-China Overseas employees or persons without contractual relationship with China Overseas, such as senders, consignees, third parties, customs or other government departments; labor disputes; electromagnetic damage or deletion of electronic audio-visual images, data or records.

十一、寄件人的保证和赔偿责任

XI. The sender's guarantee and liability for compensation

寄件人违反有关法律法规或违反以下保证和陈述，寄件人应承担因此产生的所有费用和赔偿因此而给中海外造成的损失和损害：

If the sender violates relevant laws and regulations or violates the following guarantees and statements, the sender shall bear all expenses incurred and compensate for the losses and damages caused to China Overseas due to such violations:

1）寄件人或其代理人提供的所有信息都是完整和准确的；

All information provided by the sender or its agent is complete and accurate;

2）货物是由寄件人或其雇员在安全的前提下准备的；

2) The goods were prepared by the sender or their employees under safe conditions;

3）为寄件人准备货物的人员足可信赖；

3) The personnel who prepare the goods for the sender are trustworthy;

4）寄件人应确保货物在准备、仓储或运输过程中中海外免受他人不当干扰；

The sender should ensure that the goods are protected from improper interference during preparation, storage, or transportation by overseas customs;

5）货物所有标识完整准确，地址清晰，包装妥当，适于一般注意程度下的安全运输；

5) All identification of the goods is complete and accurate, the address is clear, the packaging is appropriate, and it is suitable for safe transportation under general attention levels;

6）符合有关海关和进出口的规定，以及其他法律法规的规定。

6) Comply with relevant customs and import and export regulations, as well as other laws and regulations.

十二、路线

XII. Route

寄件人接受承运商安排的所有路线和绕航，包括可能的运输中转站。

The sender accepts all routes and deviations arranged by the carrier, including possible transit stops during transportation.

十三、账号审核认证

XIII. Account verification and authentication

寄件人在使用中海外服务前，需提供真实有效资料对账号进行认证激活。账号激活后才能正常享受中海外所提供服务。详情请见《中海外账号激活须知》。

Before using the services of China Overseas, the sender needs to provide authentic and valid information to authenticate and activate the account. Only after the account is activated can the sender enjoy the services provided by China Overseas. For details, please refer to the "Notice on Account Activation of China Overseas".

十四、法律适用和争议解决

XIV. Applicable Laws and Dispute Resolution

考虑到中海外的利益，除与所适用法律冲突，与本条款有关的一切争议将受到货件原寄件地国法院的非排他管辖，并适用原寄件地国法律，寄件人不可撤销地接受该管辖。

In consideration of the interests of China Shipping Overseas, all disputes related to this clause will be subject to the non-exclusive jurisdiction of the court of the country where the shipment originated, except for conflicts with applicable laws, and the laws of the country of origin will apply. The sender irrevocably accepts this jurisdiction.

十五、可分割性

XV. Divisibility

本条款任何部分的无效或不可执行，不影响其他条款的效力和执行。

The invalidity or unenforceability of any part of this clause does not affect the validity and enforceability of other clauses.
